Employment (Contractual Retirement Ages) Act 2025

President Catherine Connolly has signed the Employment (Contractual Retirement Ages) Act 2025 into law.

Once this legislation comes into effect, Organisations seeking to rely on a contractual retirement age which is below the State pension age of 66 will need to comply with a new consent-based framework before confirming any decisions in relation to the Employee concerned.

The legislation requires a commencement order before it comes into force.

What does this mean for Organisations?

Organisations that wish to rely on a contractual retirement age below the State pension age of 66 will need to be prepared to document Employee notifications and to provide reasoned replies within one month.

Organisations will need to review in-scope mandatory retirement age clauses in employment contracts and update retirement policies and procedures to ensure compliance with this new consent-based framework.
