Revised Code of Practice on Access to Part‑Time Working Signed into Law

Minister of State for Small Businesses, Retail and Employment at the Department of Enterprise, Tourism and Employment, Alan Dillon, has signed into law a revised Code of Practice on Access to Part Time Working.

Prepared by the Workplace Relations Commission, the updated Code provides practical guidance to help Employers and Employees agree part time arrangements that support flexible, inclusive and modern workplaces.

What does this mean for Organisations?

While Codes of Practice are not legally binding of themselves, they can be used in evidence against Employers in claims for breach of employment rights. In any proceedings before a Court, the Labour Court, or a Workplace Relations Commission Officer, a Code of Practice is admissible in evidence and any provision of the Code which appears to the court, body or officer concerned to be relevant to any question arising in the proceedings shall be taken into account in determining that question.

As best practice, Organisations should consider either introducing, in consultation with their Employees (and/or Employee representatives) new policies or reviewing existing policies to facilitate effective access to and performance of part-time work and specify how part-time working arrangements will operate in the Organisation.
