The Industrial Relations (Amendment) Act 2015 (No. 27 of 2015) was signed by the Presidential Commission on 22nd July 2015 and commenced on August 1st 2015 by way of the Industrial Relations (Amendment) Act 2015 (Commencement) Order 2015 (S.I. 329 of 2015).

  • Help Desk - Transfer of Undertakings (TUPE) – Organisations Obligations

    Transfer of Undertakings regulations apply where a business, or part of a business (including the assignment or forfeiture of a lease) transfers from one owner to another. They are designed to safeguard Employee rights in the event of such a transfer, and establish the responsibilities of both the previous and new owners of a business. The legislation that should be considered when looking at transfer of undertakings is the European Communities (Protection of Employees on Transfer of Undertakings) regulations 2003 which implement an EU Directive aimed at safeguarding the rights of Employees in the event of a transfer of an undertaking, business or part of a business to another Employer as a result of a legal transfer or merger.
