  • Topic - Drug and Alcohol in the Workplace – what Employers need to be aware of

    It is important that as an Employer you are clear as to what your obligations are if an Employee attends for work under the influence of intoxicants. Being under the influence of an intoxicant in the workplace can lead to accidents, poor performance and behavioural difficulties, and may be dealt with by Employers as a disciplinary issue. However, since Employees have a statutory obligation not to attend work under the influence and Employers have a statutory obligation to take all reasonable steps to eliminate or reduce risks of unsafe work environments, to include risks created by Employee substance abuse, having a policy and procedure in place to test Employees for intoxicants may be merited.

    The terms ‘employed’ and ‘self-employed’ are not defined law. The decision as to which category an individual falls into must be arrived at by looking at what an individual actually does, the way they do it and the terms and conditions under which they are engaged, through a written agreement or verbal agreement or implied. It is not simply a matter of the Employer or the individual calling your job ‘employment’ or ‘self-employed’.
