  • Labour Court Rule on Sunday Premium & Sick Pay

    In a recent and very interesting case relating to the payment of Sunday premium in the context of sick pay, the Labour Court overturned the earlier decision of the WRC Adjudication Officer. The case in question Ref: PDW 1716 was heard under Section 7 (1) of the Payment of Wages Act 1991. The Complainant (Employee) submitted that he should have received payment for his absence on Sunday 6th September 2016 at the premium rate because he had previously received sick pay calculated in this manner in respect of other Sundays he had been rostered to work but had been absent due to illness.

  • Court is emphatic that time changes TUPE arrangements

    From to time to time HR Managers, Consultants and Practitioners have had to grapple with what is without doubt one of the most complex and indeed often perplexing pieces of employment protection legislation, namely the European Communities (Protection of Employees on Transfer of Undertakings) Regulation, 2003 or more commonly referred to as “Transfer of Undertakings Protection of Employment” (TUPE). This case in point Ref: TU17/2 was referred to the Labour Court by SIPTU on behalf of 15 of its members employed by Woodies DIY Ltd and the case was adjudicated upon under Section 11 (1) of the Regulation.
