  • The Perils of “Employer Discretion” On Sick Pay

    In cases whereby Employers provide sick pay support for Employees the sick pay schemes are most often either as a straightforward condition of employment right, or at the Employer’s discretion. Often, the difficultly that can arise in the case of “discretion” is that Employees’ may raise a grievance in the event of sick pay cover being refused under the Employer discretion rule. In this context Employers must always be cognitive of the reason for such refusal and be sure that the reason in this regard is consistent with previous refusals and is clearly consistent with the rules governing the scheme, as well as of course equality considerations.

  • TEEU To Quick Out of Traps in 2016 With Hefty Pay Claim

    In what the Labour entitle “National Pay Claim” (Case Ref: LCR21112) the TEEU set their stall out for a 5% pay increase over 12 months. The claim issued to both the Electrical Contractors Association (ECA) and the Association of Electrical Contractors Ireland (AECI) provides perhaps a level of credence that the construction industry is now showing good recovery from the effects of the unprecedented meltdown and collapse of the economy of the late naughties. Such pay claims and their outcomes, particularly in this sector, will also be eagerly watched by all national IR stakeholders and practitioners alike be they unions, Employer bodies and of course the Government.
