  • ‘Opening the Books’ - Assessor To Be Appointed In City Jet Row On Pay Restoration

    In a dispute relating to pay restoration between City Jet and its Pilots, represented by the Unite trade union, the Labour Court has recommended a Financial Assessor be agreed between the parties in the context of establishing the merits or otherwise of the company’s assertion of being “in a challenging but improving financial situation” and so does not have the ability to absorb the increasing cost of the union claim.

  • TUPE Shift Roster Dispute at DCU

    Transfer of Undertakings Protection of Employment (TUPE) cases are very complex at the best of times. In this case in point, Unite v DCU, Labour Court Ref: LCR 21415 there are certainly some TUPE and IR considerations to note. Firstly, the case itself was not directly a TUPE case and the Court made clear in its summary that the dispute was not within the scope of the TUPE legislation (S1 131 2003) but TUPE is prevalent and coupled with an IR principle the union Unite were able to make successful argument.
