    Most cases of employers seeking to reduce the pay, the terms and the conditions of an employee is faced with little opposition, as often these reductions are required to preserve the business and are agreed with employees. A recent appeal case by the Labour Court found that an employer had unfairly reduced an employees pay on the basis that the pay rate was set in error.

    Whilst the Labour Court seeks to issue recommendations based upon the merit of respective arguments, growing evidence to suggests that when it comes to issuing recommendations on disputes relating to enhanced redundancy that involves organisations who receive direct or indirect funds from the State, regardless of the financial position of those organisations.
