  • Excessive Written Warning

    A recent ruling from the Labour Court highlights the futility of issuing disciplinary written warnings for periods in excess of one year. The case in question Ref: LCR21288 was taken by SIPTU on behalf of one of its members against Schenker Ireland Ltd and whist it appears there was definite merit in the case for the employer, the subsequent issuing of what was an extended warning had the effect to undermine the case of the employer in the context of proportionality.
