In recent years, there has been a significant increase in case law in this sphere, in particular concerning the challenges around compulsorily retiring an Employee on the grounds of age. Historically, in many Organisations Employees have been required to retire on attaining 65 years of age. The question frequently asked by Employers is whether Organisations can stand over compulsorily retiring Employees from work on the attainment of a certain age, without potentially facing a claim of discrimination on the grounds of age.
