  • Union Accept “Performance Management” In Collective Pay Parity Dispute

    One of the frustrations often articulated by Employers, or Employer body groups, in the context of collective disputes on pay parity is what is regularly considered a “catch all” or “blanket” approach to the resolution of such disputes. In effect, the solutions, in this contest, usually means the lowest common denominator group rises, as opposed to the higher earning group coming down. However, in a recent Labour Court Recommendation, involving SIPTU and Glanbia, the Court set out the principles of resolving such a dispute in a manner whereby the union SIPTU would sign up to arrangements to improve the performance of the local organisation before any additional consideration could be applied to the pay parity claim.

  • Court Reaffirms “Buy Out” at 18 Months The Loss

    It is perhaps getting to the stage whereby, all things being equal, one can almost take it for granted that when it comes to disputes that involve loss of pay or allowances for workers the Labour Court will likely recommend compensation or “buy out” of 18 months the value of that loss. In a most recent case in point involving a claimed breach of contract / loss of earnings, involving Galway Mayo Institute of Technology and SIPTU (ref: LCR21649) the Court reaffirmed what must now be considered a norm. The Union claimed that unilateral changes were made to their members’ terms and conditions of employment resulting in significant ongoing losses.
