What is Working Time?

Working time is defined as any time that the Employee is:

  • At his or her place of work or at his/her Employer's disposal, and,
  • Is carrying on or performing the activities or duties of his or her work.
What are the maximum weekly working hours for Employees?
The Organisation of Working Time Act sets out that an Employee shall not be permitted by their Employer to work, in each period of 7 days, more than an average of 48 hour calculated over a period of 4 months, 6 months or 12 month reference period in different circumstances.
What is a reference period?

A reference period comprises of a period of consecutive days or months, which does not include:

  • Any period of Annual Leave granted to the Employee concerned – This refers to Statutory Annual leave granted;
  • Any absence from work by the Employee concerned relating to Maternity or Adoptive Leave;
  • Any Sick leave taken by the Employee concerned.
